These Terms of Service ("Terms") govern your access to and use of the website, telehealth platform, and related services (collectively, the "Services") provided by Herexa Women’s Health, P.A ("Herexa," "we," "our," or "us"). By accessing or using our Services, you agree to be bound by these Terms.

If you do not agree to these Terms, you must not access or use the Services.

IMPORTANT NOTICE

Herexa provides online women’s health telehealth services reviewed by a Florida and New York licensed physician, including Dr. Amir Shay, MD. Completion of an online assessment allows a licensed physician to review your information and determine whether treatment is clinically appropriate. Consultation fee: $59 (medication not included).

1. Eligibility

By using our Services, you represent and warrant that:

You are at least 18 years of age.
You are physically located in the State of Florida or New York at the time of receiving telehealth services.
You provide accurate, current, and complete information.
You use the Services only for lawful healthcare purposes.

Telehealth services are available only in Florida and New York where our licensed providers are authorized to practice.

2. Description of Services

Herexa provides a secure online platform that enables patients to submit medical information for review by a licensed healthcare provider.

Medical assessments are reviewed by a licensed physician.
The physician determines whether treatment is clinically appropriate.
Some medical conditions may require in-person evaluation or additional care.

The Services are not intended for emergency medical conditions. If you are experiencing a medical emergency, call 911 or seek immediate in-person medical care.

3. Medical Disclaimer

Healthcare services are provided by independent licensed healthcare providers who are responsible for medical decisions and patient care.

Herexa does not guarantee diagnosis, treatment, or prescriptions.
Prescriptions may be issued only if clinically appropriate.
Medical outcomes vary based on individual health conditions.

Telehealth services do not replace ongoing relationships with primary care providers where appropriate.

4. User Responsibilities

You agree that you will:

Provide truthful and accurate medical information.
Update information when your health status changes.
Follow physician instructions and prescribed treatment plans.
Maintain the confidentiality of your account credentials.

You are responsible for activity conducted through your account.

5. Prescriptions

Prescriptions are issued at the sole discretion of the evaluating physician and only when medically appropriate and permitted by law.

Completion of an assessment does not guarantee a prescription.
Additional medical information or in-person evaluation may be required.
Some treatments may not be suitable for telehealth care.

6. Payments and Fees

The consultation fee is $59 and covers physician review of your medical assessment. Medication costs are not included.

Payments are processed through secure third-party payment providers.
Fees may change with notice posted on the website.

Refund eligibility is governed by our Refund Policy.

7. Prohibited Uses

You agree not to:

Provide false or misleading medical information.
Attempt to obtain medications unlawfully.
Interfere with platform security or functionality.
Use the Services for illegal or fraudulent activity.

Violation of these Terms may result in suspension or termination of access.

8. Limitation of Liability

To the fullest extent permitted by law, Herexa shall not be liable for indirect or consequential damages arising from use of the Services. Licensed healthcare providers remain responsible for clinical decisions and patient care.

9. Governing Law

These Terms are governed by the laws of the State of Florida and New York. Any disputes shall be resolved in courts located within Florida or New York, United States.
